The nonprofit consumer organization Privacy Rights Clearinghouse, identified over 227 million individual records containing sensitive personal information that were involved in security breaches in the U.S. during the period 2005 through 2008.

Is the Professional Liability policy guaranteed issue?

All applicants will have to go through underwriting review during the application process. However, our underwriting guidelines have been set with the behavioral and allied health professional needs in mind.

Why do I need Professional Liability Insurance?

Professional liability insurance protects behavioral and allied health professionals if sued for malpractice. You need protection from legal action due to negligent acts, errors, and omissions on the job and from frivolous lawsuits that can be brought even years later.

Without coverage, you could spend precious time and resources defending yourself, regardless of whether there is any merit to the claim. Professional liability insurance provides you with experienced legal defense and coverage for settlements or damages.

What about the Professional Liability premium cost to me?

Our Professional Liability Insurance policy coverage is half to one-third the premium cost because your carrier the Preferra Insurance Company RRG, formerly NASW Risk Retention Group (RRG) is owned by the policyholders and does not have earnings demands set by Wall Street stockholders.

Are your insurance policy contracts complicated and difficult to understand?

No. The RRG’s contract policies are written in clear, simple, and easy to understand language with all coverages clearly stated. Unlike the competitors, there is no foggy gibberish language, confusing cross-references or buried exclusions that confuse people. What you see is what you get with the RRG.

What are the Professional Liability Insurance policy limits?

Our policy has four (4) sets of limits of liability to choose from:

  • $1,000,000 per occurrence and $3,000,000 in aggregate
  • $1,000,000 per occurrence and $5,000,000 in aggregate
  • $2,000,000 per occurrence and $4,000,000 in aggregate
  • $3,000,000 per occurrence and $5,000,000 in aggregate*

*This option is available only for Virginia residents (Individual policy) and businesses based in Virginia (Group policy).

What is the difference between Claims-Made and Occurrence?

Although very similar, the occurrence policy is more expensive, but you don't have to purchase a tail or extended reporting period (ERP) coverage after the policy is no longer needed. On a claims-made policy or contract, at the end of the coverage, purchase of the tail or ERP is required to report claims that surface later on after the policy is no longer needed. What benefits are included with your Professional Liability Insurance policy?

Our policy includes four (4) sets of limits of liability to choose from plus these additional benefits:

  • $35,000 Licensing Board Defense Coverage
  • $35,000 Wage Loss and Expense Coverage per policy period/$1,000 per day
  • $25,000 Sexual Misconduct Coverage with defense costs covered in addition to the limit

Can I select my own lawyer to defend me?

Yes, but you pay the costs if the lawyer is not in our network. We provide legal defense from our lawyer network of over 350 lawyers in all 50 states to defend you. We pay these legal costs.

Is the General Liability policy guaranteed issue?

Yes. As long as you fit into one of the many occupations listed (on the application form). We only ask a few basic information questions to calculate the premium based on your needs, and then to enroll you.

Why do I need General liability insurance and why buy it from you?

Landlords typically require this and no professional liability policies have sufficient GL comprehensive coverage. Most GL policies fail to offer fire liability over $50,000 per incident. The RRG policy includes fire coverage up to $1,000,000 per occurrence and up to $3,000,000 per policy year. Virtually all carriers stop at one occurrence per year and limit the fire coverage to $50,000.Most insurance carriers limit general liability coverage to the actual therapy sessions and to the patient only, not to patient aides and companions, or other locations in the premises beyond the immediate treatment heater. The RRG policy has no such exclusions.

What about the General Liability premium cost to me?

You will not find a General Liability policy cheaper and with as many benefits anywhere. Our General Liability policy coverage is half to one-third the premium cost because the RRG is owned by the policyholders and does not have earnings demands set by Wall Street stockholders.

How about my offices, locations and my employees when calculating my General Liability premium costs?

The RRG only rates on revenue for agencies and multi-office practices. You can have as many offices as you want and in as many states as you want with as many employees as you want without impacting premium calculation cost. For individuals there are only three simple occupational categories to choose from which keeps rating it simple.

What are the General Liability perils and limits?

$1,000,000 sub-limit per occurrence and $3,000,000 in aggregate per policy year. The perils include Property Damage, Bodily Injury, Personal Injury, Advertising Injury, and Fire Legal Liability (no $50,000 sub-limit like all other carriers).

Do I look for General Liability coverage in my Professional Liability Policy?

Absolutely not. Read your PLI policy and you will see the gaps in coverage that expose you. PLI is not General Liability and does not cover you for all of the comprehensive perils that may occur.

What is CLCS?

Cyber Liability Choice Select is a multiple indemnity and expense insurance product that insures you against third party information breach, which includes all digital and all paper records. HIPAA has severe criminal and civil fines, penalties and enforcement requirements that are costly.

What is an information records breach?

This is unauthorized disclosure to any party outside of the healthcare worker-patient relationship.

What is a third party?

A third party is a mover of your records, a data storage facility, a client information storage company, or any vendor who handles your patient records information whether online, digitally, or with paper files.

What is a first party?

A first party would be you and/or a certain employee in your practice or business who handles your records, whether digitally or in paper format.

What are the cyber laws and patient records breach laws that impact me?

Your state has a variety of laws and Licensing Board breach notification requirements that can require a lawyer to represent you, plus fines and penalties you must pay. The HIPAA High Tech Law CFR Part 160 is of particular impact to healthcare workers and requires appropriate safeguards to protect the privacy of personal health information. The law stipulates expensive notification requirements to all patients, even if only one patient record is breached. Also required are security audits and identity theft subscriptions purchased by the healthcare worker for the victims.

Why do I need Cyber Liability and Cyber Device insurance protection?
